Questions we hear often.

What is the difference between a tax audit under Section 44AB and a statutory audit?

A statutory audit (under the Companies Act) is conducted by a chartered accountant and results in an auditor's report on financial statements. A tax audit under Section 44AB is specific to the Income Tax Act and results in Form 3CA/3CD certifying the correctness of taxable income computation.

What is the TDS rate for professional services?

Under Section 194J, TDS on professional fees is 10% if the payee has PAN. For technical services (as distinguished from professional services), the rate is 2%. The threshold for TDS deduction is ₹30,000 per payee per year.

Can a company claim a deduction for salary paid to a director who is also a shareholder?

Yes. Remuneration to a working director is deductible as a business expense under Section 37, provided it is reasonable relative to services rendered and market rates, and does not exceed the limits set out in Part II of Schedule V of the Companies Act.
